RE: The tariff classification of pumps for bait tanks and live wells from Taiwan

Dear Mr. Alberdi:

In your letter dated October 3, 2002 you requested a tariff classification ruling on behalf of your client Marine Metal Products.

The items in question are described as pumps identified as the “Supersaver”, “Fishsaver”, “Airhead”, and “Baitsaver”. Descriptive literature and a sample of each pump were submitted.

Examination of the “Baitsaver” sample reveals that this pump is a watertight air pump, which is used to aerate water in bait tanks. The remaining pumps are submersible liquid pumps used by fishermen to aerate and circulate water in bait tanks and/or live wells.

The applicable subheading for the “Baitsaver” will be 8414.80.9000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other air pumps. The rate of duty will be 3.7 percent ad valorem.

The applicable subheading for the “Supersaver”, “Fishsaver”, and “Airhead” will be 8413.70.2004, HTSUS, which provides for submersible centrifugal pumps for liquids. The rate of duty is free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
